1. basic provisions
1.1 The following terms and conditions apply to all contracts between SportADD and the customer of this website www.sport-add.com. Only the following terms and conditions of SportADD apply.
1.2 The contract language is German. Before sending the order via the store system, the contract data can be printed out using the print function or saved electronically.

2. subject matter of the contract
The subject matter of the contract is the sale of goods. The characteristics of the goods are listed in the item description and the supplementary information on the SportADD website.

3. conclusion of the contract
3.1 The product presentations of the provider on the SportADD website are non-binding.
3.2 The customer can submit a binding purchase offer (order) via the store system. The goods intended for purchase are placed in the shopping cart. Changes can be made to the shopping cart at any time. After accessing the “Checkout” page and entering the personal data as well as the payment and shipping conditions, all order data and costs are displayed again. Before submitting the order, the customer has the opportunity to check and change all details. By submitting the order via the “Buy now” button, the customer submits a binding offer to the provider. The customer then receives an automatic email confirming receipt of their order, which does not yet lead to the conclusion of the contract.
3.3 The acceptance of the offer and thus the conclusion of the contract takes place by confirmation in an e-mail in which the customer is confirmed the execution of the order or delivery of the goods (order confirmation).
3.4 The order is processed and all information required in connection with the conclusion of the contract is transmitted by e-mail. The Customer must therefore ensure that the e-mail address provided to SportADD is correct and that the receipt of e-mails is technically ensured and not prevented by spam filters.

4. prices and shipping costs
4.1 The prices and shipping costs stated in the respective offers are final prices including all taxes. The customer receives an invoice with VAT shown. 4.2 The shipping costs incurred are not included in the purchase price. They can be called up via the “Payment and Shipping” page, are shown separately during the ordering process and are to be borne by the customer in addition.
5 Payment and shipping conditions 5.1 The conditions for payment and shipping can be found under the button of the same name in the navigation bar. 5.2 The payment claims arising from the concluded contract are due for payment immediately. 5.3 If goods ordered by the customer are not available for a reason for which SportADD is responsible, the customer will be informed immediately of the unavailability.

6. right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. 
The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods.
To exercise your right of withdrawal, you must inform us, Sportadd GmbH & Co. KG, Brookdamm 6, 21217 Seevetal, Germany - phone: 040 / 21040180, e-mail: info@sport-add.com, of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You can use the suggested model withdrawal form below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of withdrawal before the withdrawal period has expired.
6.1 Consequences of revocation
In the event of an effective revocation, the services received by both parties must be returned. if you are unable to return the goods received in whole or in part or only in a deteriorated condition, you must compensate SportADD for the value.
In the case of a return shipment from a delivery of goods with a total order value of up to €40, you must bear the costs of the return shipment if the delivered goods correspond to those ordered.
Otherwise the return shipment is free of charge for you.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

7. right of retention, retention of title
7.1 The customer may only exercise a right of retention insofar as it relates to claims arising from the same contractual relationship.
7.2 The goods remain the property of SportADD until the purchase price has been paid in full

8. Warranty
8.1 The statutory provisions apply.
8.2 The Customer must check the goods immediately upon delivery for completeness, obvious defects and transport damage and notify SportADD immediately of any complaints.

9. liability
9.1 SportADD is not liable for the constant availability of the website and the goods offered there.

10. place of jurisdiction and place of performance
10.1 German law applies.
10.2 Place of performance for all services arising from the business relationship with SportADD and place of jurisdiction is Winsen/Luhe
